Billions At Stake In Reporting Mandate

Deputy Assistant Attorney General Joshua Craddock announced Wednesday that states participating in Temporary Assistance for Needy Families and Supplemental Security Income programs must now require every state agency to report individuals known to be in the country unlawfully to the Department of Homeland Security. The warning carries unprecedented financial consequences, threatening $16.5 billion in TANF grants and $60 billion in SSI benefits distributed annually across all 50 states and Washington, D.C.

The new interpretation reverses a 1998 Office of Legal Counsel opinion that limited reporting requirements only to agencies directly administering welfare programs. Under the expanded mandate, state departments including colleges and motor vehicle bureaus would now face federal reporting obligations, despite illegal immigrants being ineligible for either welfare program.

Colorado Battle Previews Coming Clashes

The policy shift comes as Colorado faces a separate Justice Department lawsuit over its practice of providing in-state tuition to more than 6,000 illegal immigrants. Governor Jared Polis defended his state’s authority to define residency for tuition purposes, noting these students receive no federal financial aid. The conflict illustrates the expanding battleground between the Trump administration and Democrat-led states that have resisted cooperation with federal immigration enforcement.

Federal courts have already limited some administration attempts to require information sharing on migrants with DHS, though judges have permitted immigration authorities to collect certain data including Medicaid records. Democrat-led states have filed lawsuits to block DHS from gathering personal details of people receiving TANF funds, setting up additional legal confrontations over the new reporting requirements.

The funding threat represents another escalation in President Trump’s aggressive approach to both illegal and legal immigration since returning to office. The administration has deployed federal agents for raids in migrant communities nationwide and increasingly partnered with state and local law enforcement to locate suspected illegal immigrants.
